Devonshire Blinds Terms and Conditions For Online Sales

1 DEFINITIONS
In these terms and conditions:
Devonshire Blinds/we/us/our means Devonshire Blinds Ltd. (Company registration no. 4634850) having registered offices at 17 St Peters Place, Fleetwood, Lancashire. FY7 6EB.
You or your means the individual ordering goods from Devonshire Blinds.
Goods means the merchandise manufactured or supplied to you by us as described in your order confirmation.

2 INTRODUCTION
2.1 These terms and conditions relate solely to goods, which we offer for sale via our online site to you. These terms and conditions do not relate to any other good or services Devonshire Blinds provides. By making an offer to purchase goods via our online site you agree to be bound by the whole provision of this agreement between you and us. If you do not accept any or all of the point arising within these terms and conditions you should not place an order with us.
2.2 We shall notify you of acceptance of your order by e-mail to the e-mail address supplied by you in the order form as soon as possible.
2.3 We regret that we cannot accept orders by persons located or resident outside of the United Kingdom.

3 PRODUCT DESCRIPTIONS
3.1 The product information, photographs and all images contained within our website are provided for illustrative purposes only and therefore may not be accurate. We would recommend that you order a free sample of the product before placing your order to ensure that the material, colour, etc. is as you expect.
3.2 Devonshire Blinds will attempt to ensure that any goods delivered to you match in every respect any samples or descriptions provided, however slight variation may occur with regards to colour and material between the delivered goods and any samples or descriptions given. Any minor or immaterial variation or change in colour or material will not entitle you to reject the goods nor to claim any compensation for such variation or change.

4 MEASUREMENTS
4.1 All of our goods are manufactured specifically to your measurements you provide within your order. It is very important that your measurements are accurate. We will not accept the return of goods due to your measurement you provided us being incorrect. Please read the how to measure guide found on our website or contact us via email on info@devonshireblinds.co.uk if you require further assistance on how to measure accurately.

5 PRICE AND PAYMENT
5.1 All prices are quoted in UK pound sterling.
5.2 The price for any goods ordered by you will be shown on the order confirmation section of our website when you place your order and will include any delivery charges or taxes which may be payable.
5.3 Payment may be made using either a VISA or Mastercard credit card or a Switch, VISA Debit or Electron Debit card.
5.4 The full price of your order will be debited from your credit or debit card when we receive your order or as soon as possible subsequently.
5.5 We have made every effort to ensure that the price of goods shown on our website and order confirmation is correct. In the unlikely event of a pricing error occurring which comes to our attention you will be notified as soon as feasibly possible. You will than have the option of either (i) confirming your offer to purchase the goods at the corrected price or (ii) retracting your offer to purchase the goods and receive a full refund of any payment taken by us.

6 YOUR RIGHT TO CANCEL THIS AGREEMENT
6.1 All the goods available for you to purchase from our website are made specifically to your requirements. Under the consumer protection (distance selling) regulation 2000 (SI 2000 No. 2334) which concerns the protection of consumers in respect of distance contracts for goods and services, where the contract is made without any face-to-face contact between the consumer and supplier, you do not have a right to cancel this agreement after we have accepted your order. Your order is deemed to have been accepted upon the sending of your order confirmation e-mail (see section 2.2)

7 OUR RIGHT TO CANCEL THIS AGREEMENT
7.1 We reserve the right to cancel your order for any reason beyond our reasonable control including but not limited to fire, floods, storms, industrial action, breakdown of systems or network access, non-availability of materials or the discontinuation of any product.
7.2 If you have requested delivery to an address outside the United Kingdom your order will be cancelled.
7.3 We may cancel this agreement at any time before the goods are delivered to you. If we wish to exercise our right to cancel your order you will be contacted by e-mail and informed of our intention to cancel your order. Any payment taken from your account by us will be re-credited to you promptly and in full.
7.4 We will not be obliged to offer you any compensation for disappointment suffered caused by us exercising our right to cancel this agreement.

8 DELIVERY
8.1 Devonshire Blinds will endeavour to dispatch the goods you have ordered to the address you provided within 5 full working days from the date we accept your order. In some circumstance we may not be able to dispatch the goods within this 5 working day period but orders will be sent as-soon as possible.
8.2 If we are unable to supply the goods you have ordered within 30 days of us accepting your order you will be contacted by us and informed of the delay and offered either (i) to accept a later delivery date based on when the goods are expected to be available for delivery or (ii) cancelling your order and receive a full refund of any payment taken by us for the goods which were not delivered.
8.3 The goods will be delivered to your specified delivery address during office hours, Monday to Friday. We are unable to specify the time at which the goods will be delivered.
8.4 If more than one item is ordered the goods may be delivered in instalments to decrease the delivery time for you. If this does occur no extra charges will be made for multiple deliveries.
8.5 Ownership of, and risk in, the goods will pass to you once they have been delivered to you.

9 DEFECTIVE GOODS
9.1 Devonshire Blinds warrants that all goods sold to you will be free from defects in material and workmanship for a period of 12 months from delivery of the goods to you.
9.2 In the unlikely event that you goods are found to be defective on delivery or a defect arises during the 12 month period as covered in section 9.1 please contact us via email and provide us with all relevant contact information, your order number and a description of the problem with your goods. If it appears that the goods are indeed defective then we will promptly arrange at our discretion:
9.2.1 for a courier to collect the defective goods from you and return them to us. The goods will be repaired and then returned to you free of charge,
or
9.2.2 to have new goods produced to replace the defective goods, which will be delivered to your address as described in section 8 of this agreement. Collection of the defective blinds will probably not be required.
9.3 No liability under section 9.2 shall arise if the goods have been deemed by us to have been misused, neglected or modified.
9.4 If goods are to be returned to us (as arranged by our staff) please package the goods in their original packaging material if it is still available but in any event adequately and securely enough for the goods to be protected whilst in transit. We cannot provide additional packaging materials for returning goods.
9.5 If the goods are deemed by us not defective, or are returned to us after the period of 12 months from delivery of the goods, or they have been modified, misused or the subject of negligence (see clause 9.2), You will be responsible for the payment of our charges on a time and materials basis in respect of any repairs, collection and return of goods which we agree to carry out at your request. We shall be entitled to debit such charges on the debit or credit card, which you used to order the goods, provided we notify you of the amount of such charges before carrying out the repair.
9.6 For the purpose of this contract goods are not deemed defective by reason of error in any measurements provided by you.

10 PRIVACY
10.1 You acknowledge and agree to be bound by the terms of our privacy policy. Details of which can be found on our website.

11 REPRESENTATIONS
11.1 No statement, description or recommendation contained in any price list, advertisement, communication, the pages of our website or by any employee or representative of Devonshire Blinds shall be interpreted so as to enlarge, vary or override in any way any of these terms and conditions.

12 THIRD PARTY RIGHTS
12.1 Except for our directors, employees or representatives a person who is not a party to this agreement has no rights under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

13 INVALIDITY
13.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of other parts of these conditions will not be affected.

14 LAW AND JURISTRICTION
14.1 This contract is subject to English law and the exclusive jurisdiction of the English courts.
